Judge Rejects Eminent Domain Claim

A lawsuit designed to stop the Atlantic Yards project has been thrown out by a federal judge. Brooklyn businesses and residents claimed the developer was abusing eminent domain laws.

REPORTER: The judge disagreed. Loren Riegelhaupt, a spokesman for developer Forest City Ratner, says the ruling is a green light to move forward with the massive project to building high rises along Atlantic Avenue.

RIEGELHAUPT: This decision means that we're one step closer to creating over 2,200 units of affordable housing, thousands of construction and office jobs and bringing the Nets to Brooklyn.

REPORTER: The plaintiffs say they'll appeal. One part of the ruling they liked - the judge ruled that the case did belong in federal court.
