How about asking listeners what they would ask Nominee Kagan?
For example, two of the questions that I would ask are:
1) Opportunity to Reveal Legal Skills - Give three examples of arguments that you expect attorneys pressing a RICO suit against the companies involved in Deepwater Horizon might present. Then give three examples that you expect to hear from defense attorneys might present.
2) Opportunity to Comment on New Directions for Supreme Court - Deepwater Horizon involves international corporations so that US claimants may need to press for collections in foreign courts. Describe what the government might do to facilitate such collections and what cases might be brought before the Supreme Court in this regard.
