The Supreme Court begins a new session with a new member: Justice Sonia Sotomayor. Nina Totenberg, NPR’s legal affairs correspondent, sizes up the new session and upcoming cases on issues from gun control to campaign finance.

    Brian why do you always give the prisoners the benefit of the doubt and not the government. We are a nation at war, at risk and the Obama administration is protecting the country.

    Brian why is it ok to snicker over the alleged lack of intelligence if a conservative Black Judge, would you do that to a liberal Black Judge.??

    Although the Constitution of the United States does not cite it explicitly, presumption of innocence is widely held to follow from the 5th, 6th and 14th amendments.

    should we since to a system where we are guilty until proved innocence.

    hope u are never on my jury

    Having travelled in Western China and visited Kashgar in 2000, I have seen firsthand the Chinese government’s attempts to systematically wipe out the Wiggar population. They bus in Han Chinese and essentially giving them housing and all the good jobs. The Wiggar population has a reason to be frightened, scared and to fight back. The label, "terrorist" is not correct.

    The Chinese government has used the Bush administration’s aggressive terrorist policies as cover their action. “We support the war on terror.” “Look, we have our own problems too.” And if you want to go after your terrorists, don’t mess with us when we go after our "terrorists".”

    I don’t know specifically the case of these men, but the Wiggar situation has not been reported on accurately or in any depth. Perhaps an instance of our debt to China influencing the media and/or foreign policy.
