The process to have such a trial involes hearings,jury selection and ultimatly the trial itself. This will likley take at least one year. During that time our city will be turned in to an armed camp with access to Manattan limited to people trying to live their lives. Terrorists will be climbing over each other to harm people and bring attention to their causes. All this for what? What happens if these terrorists are found NOT GUILTY? What then- Does the government release them in downtown Manhattan? NOT A CHANCE - if they were found not guilty they would be run back to GitMo. Knowing this is true, why have a sham trial. Have the military tribunal- convict them and punish them. NYC has paid enough in blood, stress and fear for our country. Let us live in peace- Have the trial anywhere else.
First, I find it disturbing that a former prosecutor of international terrorists, i.e., the Mafia, does not support the federal court system. I think it would set a dangerous president to treat the murders of all those people as the destruction of a military objective. It was a criminal act, albeit very big, but criminal none the less.
To make the matter military would, in my opinion, raise the stature and standing of the persons responsible for the crimes of 911.
I have confidence in our law enforcement and I say smoke out the terrorists in the US and let them try and let us catch them.
Firsts thing I would do as KSM's lawyer....Ask for a change of venue. How can he get a fair trial in NYC with such a poisoned jury pool?
BTW, I had dinner at a charity event with the Federal judge who tried the terrorists responsible for the first WTC attack. Guess what? That judge is still alive and walking around NYC without any security.
Also, this may come as a shock to some, but they do have Google Maps in other countries and some terrorists do know how to spell NYC. I know...quite terrifying.
