As for Justice Antonin Scalia‘s dissenting remark "will make the war harder on us. It will almost certainly cause more Americans to be killed." is passive aggressive elitist.

I would like to ask Scalia and the other dissenting Judges, why they continue to address Americans as the only human beings whose life and rights should be recognized and matter and ask them how many Iraqi citizens have died in war game cross fire.

And why they continue to be insensitive and refer to the prisoners as “enemy combatants” when not only the Supreme Court but NO COURT has heard any of their stories!!!!

I appreciate Vanessa's comment on the Supreme Court & the presidential elections, but we need to remember that the president names not only Supreme Court justices but the *entire* federal judiciary.

The constitution was created in extraordinary times. During a period when a War had just ended not much later, the British burned down the white house. Scalia and the other dissenters have no concept of the founding father's intent. Rather, they lean towards a Mussolini style cessation of liberty and democracy and seek to undermine the founding principles of a modern society. The law is not there to protect us from crimes. It is there to insure freedom.

I think that Scalia' s dissenting argument is unconscionable. For him to lay the responsibility for the lives of Americans killed in the future on the doorstep of the 5 judges who granted habeus corpus to gitmo detainees is both dispicable, typical, and so obviously political in his use of fear to persuade opinion on any issue regarding this so called war on terror. I am happy with the ruling and sickened by how close the ruling is and by how political our COurt has become.

Justice Scalia has apparently forgotten that the drafters of the constitution had no problem risking American lives for the principals set forth in that document, including habeus corpus. Surely, when they committed themselves and their nascent country to the war of independence, our founding fathers well knew that their decision would "almost certainly cause more Americans to be killed.

I don't think habeus is generally restored. It is supposed to settle the question of is habeus only available to citizens or any human being in our judicial system has the right to petition the court to fair hearing and speedy trial, why they are being held regardless of their status in the country (citizen, legal, illegal).

Even if the DC Circuit upholds an order for a release, can you imagine the Bush administration doing it? Not a chance.

And I wonder - if I had told you in 2001 that we'd have had most of our rights stripped from us would you have believed me? Notice the circumstances of the particular case in question: These were Algerians detained in Bosnia. The court in that country ordered them released, and then they were sent to Guantanamo!

This ruling reminds us once again of the importance of the make up of the court. Anyone who feels the court is already too far right must NOT vote for McCain.

I am gratified by these results, though we can expect the Bush Administration to try to find a way around this, even though it sounds extremely decisive.

The movie "Rendition" is about what similar torture the prisoners suffered at Guantanamo. People are arrested and taken somewhere's and "questioned" with cruel and inhumane techniques.

It is wrong because we haven't established these people are terrorists and are mistreating them, even if they were, they are still human.
