New York State Attorney General Andrew Cuomo invoked the Martin Act this week to tackle five energy companies. Eric O. Corngold, executive deputy Attorney General for Economic Justice talks about the use of the Martin Act. Then, Alan Lewis, partner at Carter, Ledyard & Milburn, and Dale Bryk, senior attorney with NRDC, discuss if this is an innovative use of the Martin Act.

Would the rest of the country be better off if a version of the Martin Act is enforced in all the other states?

The sooner corporations are put under the thumb to stop acting irresponsibily, the better.
Free market ideas cannot and will not solve global warming.
What is missing from this conversation is the fact that these risks have been identified on a company specific basis for more than 10 years and such information is already available in the form of investment reports to pensions and other investorss

"Innovative use of the Martin Act", my foot. This is out and out abuse of the power of the office in order to pursue environmental policy. Are the companies in violation of the act because they didn't foresee this sort of spurious prosecution as well? What a nightmare.
