Court Rules WTC Workers' Lawsuits Can Proceed

NEW YORK, NY March 26, 2008 —A federal appeals court says lawsuits can proceed on behalf of thousands of World Trade Center workers who say they were not properly protected during post-9/11 cleanup efforts. WNYC’s Fred Mogul, has more.

Lawyers for New York City and the Port Authority had asked the 2nd U.S. Circuit Court of Appeals to dismiss the case, saying the government had legal immunity from nearly 8,000 workers' claims.

The appeals court said it is too early to decide whether the defendants can be held liable. The case should not be dismissed – at least not yet. The judges ruled that the city and the Port Authority must continue to make their case in the lower court.

Both defendants have claimed that they should not be held liable, based on legal precedent and the factual history of the cleanup. For WNYC, I’m Fred Mogul.
