Detectives Request Trial by Judge

by WNYC Newsroom

NEW YORK, NY January 25, 2008 —Three detectives charged in the fatal shooting of an unarmed man want to tried by a judge, not a jury - that's according to prosecutors and a representative for the detectives' union.

A hearing is scheduled for this afternoon to formalize the officers' plan to waive their right to a jury trial.

This, 2 days after an appeals court turned down defense lawyers' bid to move the trial out of Queens, rejecting their claims that the jury pool was quote "incurably poisoned" because of publicity about the death of Sean Bell.

He was shot as he left a Queens nightclub in November 2006. Bell's death sparked protests and criticism of police conduct.

Detectives Michael Oliver and Gescard Isnora have pleaded not guilty to manslaughter, Detective Marc Cooper has pleaded not guilty to reckless endangerment.
