DOH Tries Again with Calorie Postings

NEW YORK, NY October 24, 2007 —The health department is trying once again to get fast food chains to post calories on their menu boards.
REPORTER: The city's original effort was struck down by a judge last summer, but Health Commissioner Dr. Thomas Frieden says the regulation has been rewritten, and is ready for a second try.
FRIEDEN: 97% of customers don't see calorie information even after they've bought their meal. Making that information prominent will better inform consumers and help them make healthier choices
REPORTER: Initially, the policy only applied to restaurants that were already voluntarily providing nutritional information to customers. This time, restaurants would be required to post calories on their menus, whether they had provided that information previously or not.
Restaurants are almost certain to sue. The New York State Restaurant Association calls it "micromanaging."
