Appeals Court Tosses Out UFT's Case on Class Size

In a unanimous ruling, an appeals court has dismissed a lawsuit filed by the teacher’s union and other groups that claimed the city misused more than $700 million in state aid between 2007 and 2010 that was supposed to reduce class size.
Michael Cordozo, corporation counsel with the city's Law Department, said he's pleased the court's ruling recognized the complex questions about education budgeting, and that education officials should address them instead of the courts.
But United of Federation of Teacher's president Michael Mulgrew vowed that the UFT will continue to battle to reduce class size in New York City schools.
"We wanted to bring relief to our children and to bring them smaller classes as quickly as possible so that's why we took it to the courts in the first place," said Leonie Haimson, a plaintiff in the case with the Group Class Size Matters.
