The city is appealing a federal judge’s ruling last month in the case of World Trade Center responders and workers. The city and attorneys for about 10,000 plaintiffs proposed a settlement that could be worth more than $650 million. District Judge Alvin Hellerstein said that number is not high enough, and he also challenged the fees that would go to the plaintiffs' attorneys. Now, the city is asking a federal appeals court to overrule Hellerstein, alleging he's impeding progress by inserting himself into a private settlement.
Plaintiffs' attorneys say they've yet to decide if they'll support the appeal.
