The New York State Assembly has approved a bill to legalize same-sex marriage. Last night's vote was 89-to-52. But the measure remains stalled in the State Senate. Karen DeWitt has more from Albany.

REPORTER: The sponsor of the bill in the Assembly, Danny O'Donnell, debated while his same-sex partner of 28 years - and now fiance, watched from the gallery.

O'DONNELL: I am speaking of a piece of paper that is issued by my government that all of you have had, some of you had it two or three times.

REPORTER: Many of those who voted against the bill, including Assemblyman Dov Hikind, an orthodox Jew, cited religious reasons.

HIKIND: God laid out rules, I don't understand all of them by the way, I don't understand many of them, but I can't pick and choose. I cannot pick and choose.

REPORTER: The bill now goes to the State Senate, where the majority leader Malcolm Smith says he does not currently have enough votes to pass the measure in his house. In Albany, I'm Karen DeWitt.
