Despite Assault Charges, Senator-Elect Will Be Seated

Weeks of uncertainty about the leadership of the state senate are expected to end today with the election of Queens Democrat Malcolm Smith as Majority Leader. But still unclear is exactly what role newly-elected Bronx Senator Hiram Monserrate will play.
Monserrate is facing felony charges that he slashed his girlfriend with a broken glass. At a press conference last night, Smith said he's consulting with his legal counsel on how best to deal with any leadership roles for Monserrate, who's currently slated to chair the Consumer Protection Committee. But Smith yesterday dismissed calls from some Republican Senators that Monserrate be blocked from taking office.
SMITH: He is a senator. He will be seated. We have looked at all the public laws, and there is no reason for him not to be seated. He will be here tomorrow.
REPORTER: Also still uncertain: who will be the senator from the 11th District in Queens. A recount in the close race between incumbent Republican Frank Padavan and Democratic challenger Jim Gennaro is still tied up in court.
